How Administrative Misconduct Fuels Injustice in Prisons (47-Days In)!

This is William McCallum with Behind the Walls Talk and I want to show the people how staff and administration will fabricate a story to unjustifiably lock you behind the door in segregation. There was an altercation that occurred in the dorm I was in at Southern Correctional and I am about to show and tell the fact of the matter.

Me and the brothers were coming in from the yard, I was the last to enter the block, but before I even got to the doorway, I heard an individual shouting. So, as I come in, I see the guy on the top bunk in the dayroom fussing about someone who has taken his chair. I go sit down in my chair by the front table and as I’m sitting down, I ask the guy why he is being so loud about it and he states, “because I can.” At that point I left it alone. He gets off his bunk and continues to rant and rave during this time I find out that one of the brothers is sitting in his chair. Now the guy is irate and becomes disrespectful, so the brother tells him to come speak with him in one of the cells at the back of the block. The other brothers step back there to make sure nothing goes wrong and then all of a sudden, this dude Jack Echols starts running around jumping into the brothers’ faces. I step in and tell him to chill out and it’s not that serious. After I say that I go up the stairs and go to my cell. As I’m in my cell I hear a big commotion going on in the dayroom. I close my door and then Mr. Mwamba and other officers storm the block and witness Jack Echols still running around screaming and hollering with his shirt off bleeding. The officers lock everybody down in their cells, go and view the camera footage to see what happened and then come back in and lock up all the guys that were involved in the incident. After we came back out after they cleared lockdown, I find out what initially took place while I was in my cell and come to find out one of the brothers was having a cordial conversation with Jack Echols, then suddenly, he assaults the brother and that’s when the dayroom erupts. Two hours after I am sitting in the dayroom, and I hear my name called over the intercom to report to medical twice. As I’m walking to medical, I get to the corner to turn towards the medical and I am ambushed by the Captain, Lieutenant, 4 Sergeants, and SRG asking me to submit to the handcuffs.  I submit to the handcuffs, and they escort me to segregation already informing that Berry Mwamba (unit manager) is in classifications searching for a facility to accept me. They place me in a cell, come back 30 minutes later and place me in full restraints and take me to receiving. I am down there in full restraints for 3 hours before my property is brought to me and I sit another hour before transportation officers place me in a vehicle and emergency transfer me on a 4-hour ride to Tabor Correctional. This all took place on 10/24/24.

I signed my rights (Exhibit A)

and wrote my statement on what took place as I just explained on 10/29/24. Now on 10/31/24 just two days after signing my rights to get the 15-day investigation started my case manager comes to my cell with a notice of a hearing (Exhibit B)

to take place on 11/6/24 to inform me that there will be a 45-day extension not to exceed 60 days on me for investigation. On 11/2/24 an officer comes to my cell with the write-up (Exhibit C)

which marks the end of my investigation. I went and seen DHO (Disciplinary Hearing Officer) on 11/4/24, he asked me how I plead, I plead not guilty and began looking at the package consisting of all statements from all parties involved. He then tells me he is going to view the camera footage as I requested, and he will see me next week or the week after with a decision. On 11/6/24 two case managers came to my cell and asked if I wanted to see FCC and I asked for what, explaining that my investigation was completed on 11/2/24 and I have already seen DHO, so I refused (Exhibit D)

and they still held the extension on me. The next time I see DHO is on 11/19/24 and he asks again how I plead, I plead not guilty. He then asks me to state my argument, and I gave him the facts of the matter, which is what he will see when viewing the camera footage and not what Berry Mwamba and SRG Eddins stated when they view the camera footage. DHO said he will now view the camera footage. After doing so, he sent the package back for reinvestigation to Warden Nordan at Southern Correctional and since he couldn’t get DHO to lodge the charge against me, he never ordered a reinvestigation to send back to DHO and dropped the charge to a B99 which is nothing but a reference charge and dismissed it. on 12/3/24, I was still held in solitary confinement for 8 more days. 12/11/24 was when I was released to regular population. 47 days.

Situations like this occur all the time, it’s just that most guys do not understand the process and that allows staff and administration to manipulate the process, lodging charges. When they are exposed no one is held accountable for the fraudulent statements written and the Warden for his acceptance and submission of a written report that he knows is wrongfully accusing an individual of a charge just as I’ve shown you in the case against me. This is why we need transparency upon Disciplinary Hearing Procedures. They didn’t dismiss my charge as an A-14, they dismissed it as a charge that’s a reference to nothing, so therefore when it is looked at in the computer you would never know what it was unless you know. What they’re doing from the beginning of this procedure is a violation of the 14th Amendment. Tell your loved ones that are incarcerated to study and learn the process and when they’re faced with incidents that leads to disciplinary, write a full statement on their behalf, request for camera footage and do not plead guilty. Keep all their paperwork and if they’re wrongfully charged send it to Behind the Walls Talk, so we can have more proof of what is happening.
